Protection and Removal Order within the Scope of Law No. 6284 (2026) Protective and Preventive Measures, Application Ways, Precautionary Period, Objection and Coercive Imprisonment as Sanction for Violating Measures have been updated as of 2026
Law No. 6284 on the Protection of the Family and Prevention of Violence Against Women provides rapid and undocumented protection to people who are subjected to violence or are at risk of violence. Proof of violence with evidence or documentation is not required for an injunction decision; As a rule, it is granted for a maximum of six months and can be extended if necessary. The law protects not only women, but also children who are victims of violence, their family members and those who are subjected to unilateral stalking. Anyone who violates the measures will be sentenced to forced imprisonment.
1. Scope of the Law: Who is Protected?
The law protects women, children, family members who have been subjected to violence or are at risk of being subjected to violence, and people who are victims of one-sided stalking. It is not necessary to be married; Divorced spouses, engaged couples, couples living together, and even people who have never lived together but are subject to persistent surveillance are also within the protection area of the Law. The concept of violence is interpreted broadly: in addition to physical violence, sexual, psychological, economic violence and threats are also included (Art. 2).
It is given by the civil authority or judge in favor of the protected person (art. 3–4). This includes providing shelter, temporary financial assistance, psychological and legal consultancy, temporary protection in case of life-threatening situations, nursery facilities and changing the workplace. The judge may also decide to conceal identity and other records.
The family court judge may decide on the following measures against the person who commits violence or is at risk of committing violence (Art. 5):
Immediate removal from the common residence or its location and allocation of the common residence to the protected person,
Surrendering weapons, not approaching the protected person under the influence of alcohol or drugs,
Participating in examination and treatment, education or counseling programme.
The judge may also order alimony in favor of the protected person, taking into account the income status of the perpetrator of violence. In cases where delay is dangerous, law enforcement officers can also take certain preventive measures; These measures are submitted to the judge for approval on the next business day at the latest.
3. How to Apply?

The most important guarantee of the law is that proof of violence with evidence or documents is not required in order to issue an injunction (Art. 8/3). Declaration is sufficient. This regulation aims to quickly protect the victim of violence; However, it should not be forgotten that untrue applications may also lead to adverse consequences in both slander and custody and divorce cases.
Injunction decisions can be given for a maximum of six months for the first time (Art. 8/1). If it is understood that the risk of violence continues, the period may be extended or the content of the measure may be changed, upon request or ex officio. In practice, courts usually set periods between one and six months. When the precautionary period expires, the protection ends automatically; Therefore, if the danger continues, an extension must be requested before the end of the period.
The person against whom an injunction decision has been issued may appeal to the family court within two weeks from the notification of the decision (Art. 9). The objection is examined by another family court (if there is only one court, the civil court of first instance) in the location of the court that made the decision, and the decision is final. In the objection, evidence (witnesses, message records, camera images, address information) must be presented to show that the allegations do not reflect the truth. The duration, scope or proportionality of the measure may also be subject to objection.
Coercive imprisonment is not a punishment, but a disciplinary measure to ensure compliance with the measure. Therefore, if the violation also constitutes a crime (threat, injury, persistent pursuit), a criminal investigation is also initiated. The crime of stalking, regulated in Article 123/A of the Turkish Penal Code, is a type of crime frequently encountered in this field.
The woman, whose divorce case was still ongoing, applied to the police station, stating that her husband was constantly threatening her on the phone and waiting in front of her workplace. The family court decided that the man should not approach the woman and her workplace or reach her through communication tools for two months. The man continued to send messages a week after the decision.
Sending messages violates the communication ban. Upon the woman's application with screenshots of the messages, the man is sentenced to 3 to 10 days of coercive imprisonment for the first violation. Threatening messages are also subject to Turkish Penal Code art. It becomes the subject of investigation within the scope of Article 106. In addition, injunction orders and violation reports are strong evidence in proving the man's serious fault in the divorce case and in the woman's claim for non-pecuniary damages.
Is it necessary to file a divorce case for a restraining order?
No. Measures within the scope of Law No. 6284 are independent of the divorce case; It can be requested both during the marriage and after the divorce.
Does the precautionary decision apply to the criminal record?
No. The cautionary decision is not a conviction and is not recorded in the criminal record. However, if the violation constitutes a crime, the outcome of the criminal trial may be recorded.
What happens if the protected person takes the violent person home voluntarily?
The injunction is legally binding as long as it remains in force. The protected person's consent does not annul the decision; An application must be made to the court to lift the measure.
Can men also benefit from Law No. 6284?
Yes. Although the name of the law highlights violence against women, the protection for family members and victims of stalking is gender-neutral.
Thinking that protection continues without realizing that the precautionary period has ended.
Failing to document violations; Message, call log and witness information must be stored.
The person against whom a precautionary measure has been issued misses the two-week objection period.
Not presenting the precautionary decision as evidence in the divorce case.
Making a false application; This situation leads to the crime of slander and loss of trust in lawsuits.
