Guide to the Crime and Punishment of Deliberate Murder (TCK Article 81)

Crime and Punishment of Deliberate Murder (TCK Article 81): Detection of Intent, Qualified Circumstances and Execution Deliberate Murder, Attempt, Unfair Provocation and Conditional Release within the Scope of Turkish Penal Code Articles 81, 82 and 83. This guide has been updated as of 2026, based on the Turkish Penal Code and the established jurisprudence of the Supreme Court of Appeals Criminal General Assembly.

Summary

The penalty for the basic crime of intentional murder is life imprisonment; In case of one of the eleven qualifying circumstances listed in Article 82 of the Turkish Penal Code, the penalty becomes aggravated life imprisonment. In most of the files, the main debate is not the amount of punishment, but whether the perpetrator acted with the intent to kill or to injure; The Supreme Court evaluates this distinction based on the number of blows, the targeted area, the nature of the tool used, and the behavior before and after the incident. In case of attempt, a prison sentence of thirteen to twenty years instead of aggravated life imprisonment is imposed, and a prison sentence of nine to fifteen years instead of life imprisonment is imposed. Unfair provocation, exceeding the limit in self-defense and being under age are decisive reasons for reducing the sentence.

1. Where Does the Real Discussion Begin in Premeditated Murder Files?

The severity of the punishment in cases resulting in death can be easily read from the text of the law. On the other hand, in most of the trials in high criminal courts, the main dispute centers on the legal nature of the act rather than the amount of the penalty. Did the perpetrator act with the intent to kill, or did the action he took with the intent to injure produce an unexpected result? The answer to this question makes a difference between life imprisonment and limited time imprisonment in the same case.

The guide deals with the elements of the crime of intentional homicide, the criteria applied to determine intent, qualified circumstances, the manner of committing negligent behavior, attempt, the reasons for reducing or abolishing the penalty, and the execution regime.

2. Elements of the Crime of Intentional Murder

Article 81 of the Turkish Penal Code provides that a person who deliberately kills a person will be punished with life imprisonment. The protected legal value of this crime, which is listed among crimes against life, is the right to life.

In terms of the material element, the perpetrator must perform an action that is conducive to death, the result of death must occur, and there must be a causal link between the action and the result. The act can be committed by a direct physical intervention or by negligent behavior under the conditions required by law.

The moral element is caste. The perpetrator must act knowing that his action will result in death and willing this outcome. In the case of possible intent, the perpetrator does not directly desire the outcome but risks it to happen; In this case, the penalty is reduced at the rates prescribed by law.

Crime is a crime that can be committed by anyone and can be a victim of any living person. It is not dependent on a complaint, it is investigated ex officio and the trial is carried out in the high criminal court.

3. How to Determine Intent to Kill?

Since intent is a phenomenon related to the inner world of the perpetrator, it cannot be directly observed; It is derived from behaviors reflected in the outside world. The General Criminal Assembly of the Supreme Court of Appeals consistently uses a set of criteria when assessing the existence of intent to kill.

In establishing the defense, each of these criteria must be evaluated separately within the scope of the file.

Suitability of the tool used to kill: The quality, size and use of the tool are taken into consideration. It becomes difficult to talk about intent to kill in an action carried out with an unsuitable tool.

Number and intensity of blows: The difference between a single blow and multiple and intense blows is decisive in terms of the direction of the intent.

Targeted body part: Targeting vital areas indicates intent to kill, while choosing unsuitable areas indicates intent to injure.

The perpetrator's reason for stopping the action: It is investigated whether the perpetrator stopped the action of his own will or whether he stopped due to an external obstacle. The intent of the perpetrator who puts an end to his action even though he was not prevented becomes controversial.

Relationship and hostility before the incident: Whether there is a prior hostility between the parties is taken into account in determining the motive.

Behaviors after the incident: Whether the perpetrator takes the victim to the hospital, calls for help, or, conversely, flees the scene, constitutes a strong indicator of the direction of intent.

Distinction from Death Due to Intentional Injury

If death occurs even though the perpetrator acts with the intent to injure, the act is not considered intentional murder, but aggravated injury due to the consequence, and requires a term of imprisonment. Establishing this distinction correctly is one of the most important legal results that can be obtained in the file. A detailed examination of forensic medicine reports, autopsy findings and the nature of the scars will be decisive at this point.

Difference between Possible Intent and Conscious Negligence

In probable intent, the perpetrator takes the risk of the outcome he foresees and remains indifferent to its realization. In conscious negligence, the outcome was still foreseen, but the perpetrator acted with confidence that the outcome would not occur. The distinction is based on the determination of the perpetrator's internal attitude towards the outcome and is a matter of debate in practice, especially in cases such as traffic incidents and shooting into the crowd. Attribution directly determines the huge penalty difference between intentional homicide and reckless homicide.

4. Qualified Situations (TCK Article 82)

In case of one of the conditions listed in Article 82 of the Turkish Penal Code, the penalty becomes aggravated life imprisonment. Qualifying states are optional; The presence of more than one of them in the same incident does not increase the penalty amount, and a single aggravated life imprisonment is imposed. However, the existence of more than one qualified circumstance will be effective in determining the basic penalty and whether discretionary reductions will be applied.

Clause Qualified Case

a Premeditated killing

b Killing with bestial feeling or infliction of torture

c By fire, flood, destruction, sinking or bombing, or by the use of nuclear, biological or chemical weapons

d Against one of the ancestors or descendants, or against a spouse, divorced spouse or sibling.

e Against a child or a person who is physically or mentally unable to defend himself

f Against women

g Due to the public duty performed by the person

h In order to hide a crime, to eliminate its evidence or to facilitate its commission, or to avoid being caught

i Indignation at not being able to commit a crime

j With the motive of bloodshed

k Motivated by tradition

Proof of Design Element

Designing is the most discussed qualification in practice. It is not considered sufficient that the decision to kill has been made beforehand. After making his decision, the perpetrator is required to pass a reasonable period of time in which he can think calmly and to persevere in his decision and commit the act during this period. A decision to kill that occurs during a sudden argument is not considered premeditated. Facts such as procuring the weapon in advance, following the victim or planning the meeting are considered indicators of premeditation.

Intentional Murder Committed Against Women

This clause was amended by Law No. 7406 in 2022. While before the amendment, only the act committed against a woman known to be pregnant was considered a qualified case, with the new regulation, intentional killing committed against a woman has generally been included within the scope of qualified action. In order to apply the clause, the perpetrator is not required to have a special motive; It is enough to know that the victim is a woman. With the same law, the divorced spouse was also added to the lineage, descendants and spouse.

Condition of Connection in Acts Committed Against Public Officials

It is not enough for the victim to be a public official. The act of killing must have been committed due to the public duty performed by the person. An act committed due to a personal animosity unrelated to duty is not evaluated within the scope of this paragraph.

5. Intentional Murder through Negligence (TCK Article 83)

The crime of intentional murder can also be committed by not performing an obligatory act. The law stipulates that negligence can be punished under two conditions: the negligence must be equivalent to executive action and the perpetrator must have an obligation arising from legal regulations or contract to perform a certain behavior, or the previous behavior has created a dangerous situation for the lives of others.

Typical examples are the person under the obligation of care and supervision not fulfilling this obligation or the person creating a dangerous situation avoiding intervention that would prevent the outcome. In this case, the judge may sentence a prison sentence of twenty to twenty-five years instead of aggravated life imprisonment, fifteen to twenty years instead of life imprisonment, and in other cases, a prison sentence of ten to fifteen years instead of aggravated life imprisonment. The discretionary nature of the regulation opens a separate area of discussion in terms of defense.

6. Penalty in case of attempt

Although the perpetrator starts the execution with appropriate actions with the intention to kill, if death does not occur due to reasons beyond his control, the provisions of attempt are applied. The punishment is determined according to the severity of the damage or danger caused.

Situation Punishment for a Completed Crime Punishment in Case of Attempt

Simple intentional murder (Art. 81) Life imprisonment, 9 to 15 years imprisonment

Aggravated intentional murder (Art. 82) Aggravated life imprisonment, 13 to 20 years imprisonment

Voluntary renunciation comes into question if the perpetrator puts an end to the execution actions of his own will or prevents the outcome from occurring with his own efforts. In this case, the perpetrator is not held responsible for the attempt; He will only be punished for that crime if the actions he has committed up to that point constitute a crime in itself. The distinction between voluntary renunciation and an attempt that cannot be completed due to external obstacle radically changes the outcome of the case.

7. Reasons That Reduce and Abolish the Punishment

Unfair Provocation

A person who commits a crime under the influence of anger or severe pain caused by an unjust act is sentenced to eighteen to twenty-four years' imprisonment instead of aggravated life imprisonment, and twelve to eighteen years' imprisonment instead of life imprisonment. The discount rate varies depending on the weight of the drive.

In practice, the degree of provocation is discussed rather than its existence. In the evaluation, the nature of the tort, the previous relationship of the parties, the time elapsed between the provocation and the act, and whether the reaction is proportional to the provocation are taken into account. In cases where there are mutual torts, determining which party acted unfairly first becomes decisive.

Self-Defense and Crossing the Border

A person who acts under the obligation to repel an unjust attack against himself or another person in proportion to the attack according to the situation and conditions at the time will not be punished. It is required that the attack is occurring or reoccurring and defense is mandatory.

If the limit is exceeded without intent, the penalty is reduced. If the violation is due to excusable excitement, fear or anxiety, the perpetrator will not be punished. This provision becomes central to the defense in events that develop suddenly and where the perpetrator cannot be expected to act calmly.

Minority and Mental Illness

Children who were under the age of twelve at the time of committing the act have no criminal liability. It is investigated whether children between the ages of twelve and fifteen have the ability to perceive the legal meaning and consequences of the act and to direct their behavior. For children between the ages of fifteen and eighteen, the penalty is reduced by certain percentages. A person who cannot perceive the meaning and consequences of his act due to mental illness is not punished; Those whose perception ability is significantly reduced will have their sentences reduced. In both cases, forensic examination determines the course of the file.

8. Execution Regime and Conditional Release

The crime of deliberate murder is among the crimes that are separated from the general regime in terms of execution law. For those convicted of this crime, conditional release rates and probation periods are applied more severely than other crimes.

The convict sentenced to aggravated life imprisonment shall serve thirty years, provided that he is of good behavior; A convict sentenced to life imprisonment may benefit from conditional release after serving twenty-four years in the penal institution. These periods are further extended if the crime is committed within the framework of organizational activities or if there is more than one life sentence. Conditional release regime is also evaluated in cases where recidivism provisions apply.

In cases of attempted, unjust provocation or negligent behavior for which a term of imprisonment is imposed, the calculations for conditional release and allocation to an open penal institution are made according to the amount of the penalty and the place of the crime in the catalogue. Therefore, any reduction obtained during the trial will be directly reflected in the execution period.

Event Summary

In an argument that broke out in a coffeehouse, one of the parties insulted the other, and then the other party dealt a single blow to the victim's abdominal area with the knife he was carrying. The victim was taken to the hospital by those at the scene, while the perpetrator did not leave the scene and surrendered to the law enforcement. The victim died due to internal bleeding.

Legal Evaluation

The fact that the tool used is suitable for killing and the targeted area is of vital importance indicates intent to kill. On the other hand, the fact that the blow was a single blow, that the perpetrator ended his action without any external obstacle, and that he surrendered without running away from the scene are facts that support the defense that the intention was to injure. Characterization is made by evaluating the depth of the wound and the nature of the organ damage in the forensic medicine report. In addition, since the victim had insulting words before the incident, whether the provisions of unfair provocation will be applied and the degree of provocation are also discussed. Since there is no evidence that the act was designed, the qualified case does not come into question.

9. Frequently Asked Questions

Does withdrawing the complaint in the crime of intentional murder drop the case?

No. Crime is not dependent on complaint and is investigated ex officio. If the relatives of the victims give up the complaint, it does not drop the public case; It only affects participation capacity and compensation claims.

Is committing a crime with a weapon automatically a qualified act?

The use of a weapon alone is not one of the qualified situations listed in Article 82 of the Turkish Penal Code. However, the nature of the weapon is taken into account in determining intent and determining the basic punishment. If the gun is unlicensed, liability will also arise within the scope of Law No. 6136.

Does life imprisonment mean staying in prison for life?

Conditional release is possible in life imprisonment, and the convict can benefit from this right after twenty-four years if he meets the good behavior condition. In aggravated life imprisonment, this period is thirty years. On the other hand, in both sentences, release does not occur automatically.

Does the penalty increase if there is more than one qualified circumstance?

Since the qualified conditions are optional, having more than one does not result in separate penalties; Again, a single sentence of aggravated life imprisonment is imposed. However, this situation may be considered as not applying discretionary discount.

Does the statute of limitations apply to the case of intentional murder?

Yes. The statute of limitations for crimes that require aggravated life imprisonment is thirty years, and for crimes that require life imprisonment, it is twenty-five years. The period begins to run from the date of the crime and is interrupted or stopped in cases listed in the law.

Can the relatives of the victims claim compensation? Yes. Independent of the criminal proceedings, a lawsuit can be filed in civil court seeking compensation for loss of support and non-pecuniary damage. Participation in criminal proceedings does not eliminate the right to compensation.

Attention: Common Mistakes in the Process

Giving the first statement without preparation: Statements at the law enforcement and prosecutor's office stages are the most frequently used sources in evaluating the direction of intent. Subsequent statements do not easily negate the effect of a previous statement.

Not questioning the forensic report: The number of wounds, their depth and the hit area are decisive in determining intent. In cases where the report is incomplete or contradictory, an additional report or a higher committee review of the Forensic Medicine Institute should be requested.

Neglecting the degree of unjust provocation: Accepting the existence of provocation should not be considered sufficient; the existence of severe provocation conditions must be demonstrated with concrete facts.

Failure to respond to the allegation of planning: If it is not shown that there was no period of time between the decision to kill and the act that allowed for calm reflection, the punishment may directly turn into aggravated life imprisonment.

Late request of camera and communication records: The retention period of security camera images is limited; Failure to request it immediately after the incident will result in irreparable loss of evidence.

10. Conclusion

Premeditated murder trials are cases where the most severe sanctions of Turkish criminal law are applied and every stage of the process directly affects the outcome. Correctly establishing the distinction between intent to kill and intent to injure, meeting the allegations of qualified action on concrete facts, adapting the provisions of unfair provocation and self-defense to the file, technically auditing forensic medicine reports and reflecting any reduction obtained on the execution period are aspects of the defense that require expertise.
