Summary

Foreigners who will receive higher education in Türkiye are given a student residence permit in accordance with Article 38 of Law No. 6458. For permission, education documents such as acceptance or registration certificate, address information and the absence of any obstacle to entry are required. Student residence permit does not provide residence permit rights to the student's parents and other relatives. The student's work is dependent on a work permit; Associate and undergraduate students can apply after completing their first year of education. Residence and work options after graduation are also regulated by the law.

Who is granted a Student Residence Permit?

According to Article 38 of the Law, student residence permits are issued in two groups:

Foreigners who will receive associate's degree, bachelor's degree, master's degree or doctorate education at a higher education institution in Türkiye (Art. 38/1),

For foreigners who will receive primary and secondary education, whose care and expenses are undertaken by a real or legal person, for one-year periods, with the consent of their parents or legal representatives (Art. 38/2).

If the education period is less than one year, the leave period cannot exceed the education period (Art. 38/4). Those who come through public institutions are allowed during their education (Art. 38/5).

What Conditions Are Required for a Student Residence Permit?

Article 39 of the law stipulates three conditions:

38. To submit the information and documents within the scope of the article,

7. Not falling within the scope of the article, that is, there are no reasons preventing entry to Türkiye,

Providing address information where you will stay in Türkiye.

The university's acceptance or registration certificate is usually used as the education document. The application method varies depending on whether the student is in Türkiye or not. Application from abroad to the consulate; Application from within Türkiye is made to the governorship in the cases listed in Article 22 of the Law.

Under what circumstances is a Student Residence Permit Refused or Cancelled?

According to Article 40 of the Law, student residence permit is not granted in the following cases; if it is granted, it is canceled and its duration is not extended:

39. The conditions sought in the article are not met or disappear,

Emergence of evidence that education cannot be continued,

Determining that the permission is used for purposes other than the one for which it was given,

There is a valid deportation decision or a ban on entry to Türkiye.

The second reason is important in practice. Dropping out of school, disenrollment, or failure to meet attendance requirements may affect the leave process. It is therefore useful to keep documents showing that the relationship with the university is ongoing.

Is It Possible to Work While a Student?

According to Article 19 of Law No. 6735, foreign students enrolled in formal education programs can work provided that they obtain a work permit. Associate and undergraduate students can apply for a work permit after completing the first year of their education and work part-time in accordance with the Labor Law No. 4857. These restrictions do not apply to graduate students. The work permit does not terminate the valid student residence permit and the rights provided by this permit (Art. 19/3).

Article 41 of the law states that students can only work if they obtain a work permit, and that associate and undergraduate students will have the right to work after the first year. Working without permission may result in cancellation of residence permit and deportation.

Is it Possible to Stay and Work in Türkiye After Graduation?

There are two separate paths for post-graduation:

If a foreigner who has completed his higher education in Türkiye applies for a work permit within one year from the date of graduation, the application will be evaluated according to the principles determined by the International Labor Policy Advisory Board (6735 Art. 19/5). Those who have completed their higher education can obtain a short-term residence permit in accordance with subparagraph (i) of the first paragraph of Article 31 of Law No. 6458. The application is made within six months after completion of education and the permit is granted once for a maximum of one year (Art. 31/4).

These two paths should be considered as complementary options. Since the deadlines are short, graduation planning should be done in advance.

Does the Student Residence Permit count towards Long-Term Residence and Citizenship Periods?

According to Article 28 of the Law, half of the student residence permits are taken into account when calculating the uninterrupted residence period. This means that the years of education are not counted as a whole when calculating the eight-year period required for a long-term residence permit. The residence requirement for citizenship is also regulated in the Turkish Citizenship Law and must be evaluated on a case-by-case basis in each application.

What is the Recourse in Case of Rejection?

Against the rejection of the student residence permit request, an annulment lawsuit can be filed in the administrative court within 60 days from the notification (IYUK art. 7). Application to a higher authority suspends the litigation period (İYUK art. 11). If deregistration, absenteeism or misuse is claimed as a reason, correspondence with the university and registration documents become important as evidence.
