Illegal Betting Penalty 2026: Sanctions for Betting, Playing and Using Accounts Administrative fines, acts requiring imprisonment, appeal and account blocking within the scope of Article 5 of Law No. 7258 have been updated as of 2026

Summary

The person who makes coupons on an illegal betting site and the person who operates this site, advertises it or mediates the movement of money are not subject to the same legal regime. Article 5 of Law No. 7258 considers betting a misdemeanor and imposes an administrative fine; Streaming, accessing foreign sites, intermediary in money transfer and advertising are crimes punishable by imprisonment. With the revaluation, the administrative fine imposed on those who played in 2026 increased to the range of approximately 103 thousand TL and 413 thousand TL. The guide covers the distinction between acts, the current amount of fines, the procedure for objecting to administrative fines, the risk of letting someone else use the bank account, and the approach of the Supreme Court on proof.

1. Why Is Illegal Betting So Popular?

In Türkiye, betting on sports events can only be played legally through channels authorized by the Spor Toto Organization. Betting placed on websites, applications and social media groups outside of these channels is, in the words of the law, betting "without the authority granted by the law". In recent years, as a result of MASAK investigations, mass bank account analyzes and large-scale operations, thousands of people have been notified with administrative fines, and some of them face criminal investigation.

The most common problem in practice is that the person does not know for what act he is held responsible. Opening an account for a betting site by making a coupon, transferring your friend's betting money to your own IBAN, or sharing a link to a betting site on social media has very different legal consequences. The first step in defense is the correct characterization of the act.

2. Article 5 of Law No. 7258: Which Sanction for Which Act?

Article 5 of the Law has had the same structure since the amendment made in 2013 with Law No. 6495. The first paragraph of the article contains five separate clauses:

I would like a cut of T-bone Verb Sanction

5/1-a Playing betting or games of chance, or providing a place or opportunity to play them Imprisonment from 3 to 5 years and a judicial fine of up to 10,000 days

5/1-b Enabling bets placed abroad to be placed in Türkiye via the internet or other means Imprisonment from 4 to 6 years

5/1-c Intermediating money transfer in connection with betting or games of chance Imprisonment from 3 to 5 years and a judicial fine of up to 5,000 days

5/1-ç Encouraging people to place bets by advertising or otherwise Imprisonment from 1 to 3 years and a judicial fine of up to 3,000 days

5/1-d betting or playing a game of chance Administrative fine by the local administrator (approximately between 103,207 TL and 412,995 TL for 2026)

In addition, the goods used in the crime and any property value obtained through betting are confiscated, the workplace where the crime was committed is sealed for three months, and access to the websites related to the crime is blocked in accordance with Law No. 5651. After the amendment made by Law No. 7405, Spor Toto Organization Presidency can directly file a criminal complaint and participate in the lawsuit.

Why does the amount of the administrative fine change every year?

The limits foreseen for the person playing in the text of the law are 5,000 TL and 20,000 TL. However, the seventh paragraph of Article 17 of the Misdemeanor Law orders that administrative fines be increased by the revaluation rate at the beginning of each calendar year. As a result of the increases accumulated since 2014, the lower limit for 2026 is calculated as approximately 103,207 TL and the upper limit is approximately 412,995 TL. In practice, it is seen that the penalty is often given at the lower limit; The Supreme Court also requires that in case of determining a penalty above the upper limit, justification should be given and the principle of proportionality should be observed (Supreme Court 7. CD, E.2022/3419, K.2024/5169, 13.05.2024).

3. Difference Between Playing, Playing and Mediating

Betting: misdemeanor

The person who makes coupons only in his/her own name is considered to have committed a misdemeanor, not a crime. For this reason, no criminal case will be filed against him, and no criminal record will be created; The local authority imposes an administrative fine. However, since it is possible to apply the crime separately for each act, multiple transfers made on different dates may cause a serious financial burden in total.

Placing bets and accessing foreign sites

A person who makes others place bets, opens an account, or collects money in exchange for coupons in a coffeehouse, internet cafe, or at home commits a crime. The Supreme Court stated that in determining whether the act falls under paragraph (a) or paragraph (b), the location of the site accessed for betting will be taken as basis, not the country where the match is played; It emphasizes that for this, an expert expert review must be carried out on computer and telephone records (Supreme Court 7th CD, E.2021/17868, K.2026/556, 19.01.2026).

Intermediary in money transfer: "I just gave my account" defense

Illegal betting organizations use numerous third-party bank and payment institution accounts to collect money from players and distribute winnings. Any person who rents out his account for this purpose, surrenders his card, or transfers the incoming money to other accounts is prosecuted with the risk of 3 to 5 years of imprisonment within the scope of Article 5/1-c. This crime is a crime that can be committed intentionally; In defense, the determining factor is who the account was given to, for what reason and with what correspondence, whether the person was aware of the money movements and whether he or she had any benefits.

Gambling sites are subject to a separate provision

Games such as poker, roulette and slots that are not based on sports competitions are not covered by Law No. 7258, but by Article 228 of the Turkish Penal Code and Article 34 of the Misdemeanor Law. A much lower, fixed administrative fine is imposed on the person who gambles. In a file where the person claimed that he was playing poker, not football betting, the Supreme Court stated that the penalties for the two misdemeanors were different and sought to determine which misdemeanor the act constituted through account transactions (Supreme Court 7. CD, E.2022/9460, K.2022/15847, 07.11.2022).

4. Objection Process to Administrative Fine

In accordance with Article 27 of the Misdemeanor Law, an application can be made to the criminal judgeship of peace against an administrative fine within 15 days from the notification of the decision. If the deadline is missed, the penalty becomes final and is collected as a public receivable.

1. Determination of the date of notification: The date of the notification made through e-Government, PTT or law enforcement is documented; The 15-day period runs from this date.

2. Examination of the file: Administrative sanction decision report, MASAK report, account activity statement and investigation file on which the penalty is based are requested.

3. Application petition: The petition is submitted to the criminal judgeship of peace in two copies; It is concretely explained that the act was not committed, the evidence is insufficient, or the amount of punishment is disproportionate.

4. Payment and discount: If the penalty is paid within one month from the notification, a 25 percent discount is applied. Making payment in accordance with Article 17/6 of the Misdemeanor Law does not eliminate the right to object.

5. Objection to the decision: An objection can be made to the decision of the criminal judgeship of peace to the next criminal judgeship of peace within 7 days from the notification.

The Supreme Court's approach to proof

The Supreme Court criticizes the automatic approval of administrative fines in cases submitted to it through reversal in the interest of law. According to the established approach:

The criminal act and the evidence proving this act must be shown in a clear and auditable manner in the decision report; It is not sufficient to refer only to the article of law (7th CD, E.2022/3419, K.2024/5169).

The investigation file and MASAK report on which the penalty is based must be brought, and if necessary, an expert examination must be conducted to determine whether the person transferred money for the purpose of betting (7th CD, E.2023/18129, K.2025/11294, 29.09.2025).

If the money came to the person's account from the suspicious account, this alone does not indicate that the person is betting; The purpose of sending the money and who actually used the account should be investigated (7. CD, E.2023/18125, K.2025/11297, 29.09.2025).

5. Account Blocking, MASAK and Criminal Investigation

Suspicious betting money movements often first appear as a restriction on the bank account. This restriction may be based on MASAK's authority to postpone transactions within the scope of Law No. 5549, the CMK Article 128 seizure decision given upon the request of the public prosecutor, or the CMK Article 128/A regulation introduced with the 11th Judicial Package, which allows financial institutions to suspend suspicious accounts for a short time. Article 5 of Law No. 7258 also allows heavy protection measures such as interception of communications, technical surveillance and secret investigators in terms of these crimes.

Applications made without knowing which authority and with which file number the blockage was placed often go to the wrong authority. If the person is also called to testify as a suspect, examining the file before the statement and preparing explanations regarding account movements with documents determines the direction of the defense.

6. Civil Service, Criminal Record and Other Consequences

Situation Criminal record Practical result

Betting (5/1-d) Not committed (misdemeanor) Administrative fine; Disciplinary investigation may be brought to the agenda for public officials

Playback, mediation, access to foreign sites Processed in case of conviction Prison sentence; It is often not possible to postpone the announcement of the verdict due to lower limits

Advertisement and promotion (5/1-d) Processed in case of conviction Social media posts and phenomenon advertisements are evaluated in this context.

Gambling (Misdemeanor Article 34) not processed Fixed administrative fine and confiscation of earnings

A prison sentence of one year or more creates serious obstacles to entering and continuing to hold public office. For this reason, determining the correct defense strategy at the first stage of the investigation prevents irreparable consequences, especially for public officials, students and professional candidates subject to security investigation.

7. An Example from Practice

Event Summary

A university student gave his bank card and internet banking password to an acquaintance of his for two months after he said, "My salary will be deposited into this account, my card is blocked." During this period, money from hundreds of different people was transferred from the account to other accounts. The student's account was blocked, and then he was summoned to testify as a suspect within the scope of Article 5/1-c of Law No. 7258.

Legal Evaluation

The charge is a crime of intermediary in money transfer and carries a prison sentence of 3 to 5 years. The element of intent is at the center of the defense: the reason for which the card was given, the message records regarding this, whether the student was aware of the money movements and whether he received a commission must be clearly stated. It should be requested to have the account movements examined by an expert, to determine whether the incoming money is actually connected to the betting organization, and to determine the identity of the person using the card. In the same process, the basis of the blockage can be learned and a separate removal application can be made to the relevant authority.

8. Frequently Asked Questions

Does illegal betting require imprisonment?

Mere betting does not attract prison time; Administrative fines are imposed in accordance with Article 5/1-d of Law No. 7258. However, if the person playing makes coupons for others, collects money or allows the organization to use his account, the act becomes a crime.

How much is the penalty for betting in 2026?

After revaluation, the lower limit is approximately 103,207 TL and the upper limit is approximately 412,995 TL. If the penalty is paid within one month, a 25 percent discount is applied.

If I pay the fine, will my right to appeal be lost?

It doesn't fall. Article 17/6 of the Misdemeanor Law clearly states that payment does not affect the right to take legal action. If the objection is accepted, a refund of the paid amount may be requested.

The penalty was notified to me much later, what can be done?

Pursuant to Article 20 of the Misdemeanor Law, the statute of limitations for investigation is three to five years, depending on the amount of the penalty, and runs from the date the act was committed. The period between the date of the act and the date of the decision and the legality of the notification should also be examined in the objection petition.

Is it a crime for my friend to send betting money to my account?

Receiving money into the account alone does not indicate that the person is betting or acting as an intermediary. The Supreme Court is seeking to investigate the purpose of sending the money and who actually used the account. However, regularly transferring incoming money to other accounts strengthens the suspicion of intermediary.

Attention: Common Mistakes in the Process

Missing the 15-day objection period with the idea of "let me pay first and then look at it".

Giving the bank card, password or IBAN to someone else for reasons such as "pay will be deposited" and deleting the related correspondence.

Going to the statement without examining the file and explaining the money movements by guessing.

Defending without distinguishing between a poker or casino game and a sports bet.

Applying to the bank or the wrong authority without learning the basis for account blocking.

Conclusion

In cases of illegal betting, the same incident may result in either an administrative fine or the risk of imprisonment of up to five years, depending on the person's role. For this reason, every step taken without examining the minutes, MASAK report and account movements creates a situation that is difficult to correct later. The decisions of the Supreme Court in recent years clearly show that sentences not based on evidence can be annulled by objection.
