A Neighbour's Illegal Building: Applying to the Municipality and Legal Action

Administrative Law

Neighbor's Illegal Building: Application to the Municipality, Implied Rejection and Lawsuit in the Administrative Court Building vacation report, demolition decision, license cancellation and the neighbor's capacity to file a lawsuit. This guide has been prepared in accordance with the Zoning Law No. 3194, Article 32, Administrative Procedure Law No. 2577, Articles 2, 7, 10 and the Council of State's jurisprudence as of October 2026.

Summary

A building constructed by a neighbor without a license or against a license means loss of value, shading, fire safety and legal risk for the owner of the adjacent or nearby property. Article 32 of Law No. 3194 orders the municipality or governorship that learns of this situation to detect the structure, seal it and stop the construction immediately. If the municipality does not take action, the neighbor can apply in writing. If no response is received within thirty days, the application is deemed rejected (Article 2577, 10) and a lawsuit can be filed against the rejection in the administrative court. This guide explains how to make an application, which transactions can be the subject of a lawsuit, and what is considered in a neighbor's capacity to file a lawsuit.

1. What obligations does the Zoning Law impose on the Municipality?

According to Article 32 of the Zoning Law No. 3194, if it is determined by the relevant administration that the construction has started without obtaining a license or that a building has been built in violation of the license and its annexes, or if this situation becomes known through the notification of the technical responsible person or in any other way, the municipality or governorship determines the current construction status, seals the building and stops the construction immediately. Since the text of the law contains the expression "to become aware in any way", a notice made by a neighbor is also information that should prompt the administration to take action.

The law then regulates the operation in the following order. First, the building vacation report is posted on the building site, this action is deemed to have been notified to the building owner, and a copy is left to the headman. The building owner must make his/her building compliant with the license or obtain a license within a maximum of one month from this date. Otherwise, the license is cancelled, the unlicensed or unlicensed building is demolished by the decision of the municipal council or the provincial administrative board, and the cost is collected from the owner of the building. In buildings that are determined by the administration to be unlicensable or to have the non-compliance remedied, the license is canceled without waiting for a period of one month.

Stage Contents Rest

Detection and sealing The current construction status is determined, the structure is sealed, construction is stopped 3194 m.32/1

title deed declaration The information that the building violates the zoning legislation is notified to the land registry office within seven days at the latest and is recorded in the declarations section. 3194 art.32/1 (sentence added by Law No. 7221)

Duration for the building owner Maximum one month from the construction vacation report 3194 m.32/3

Demolition decision If the discrepancy is not remedied, the license is canceled and the council or provincial administrative board decides on demolition. 3194 m.32/5

Ministry's demolition If the Administration does not take a demolition decision within two months after the determination or does not implement the demolition decision within six months, demolition may be carried out by the Ministry; The cost is collected from the administration. 3194 m.32/5

This regulation is also important for the neighbor in terms of annotation in the title deed. The declaration in the land registry cannot be removed unless the discrepancy is corrected. In real estate buying and selling, this record serves as a warning for the buyer.

2. Written Application to the Municipality

Content of the application: Address of the building, island and parcel information, nature of the violation (unlicensed construction, unlicensed additional floor, encroachment on drawing distance, balcony extension, etc.), photographs and measurements, if any. In the application, Law No. 3194

In accordance with Article 32, determination, building holiday report and demolition procedures must be clearly requested. Place of application: Mayor or relevant governorship. The registration of the application must be documented with the document registration number and date. License information request: Within the scope of the Right to Information Law, a copy of the building's license and annexes may also be requested. A project is needed to concretely demonstrate the violation of the license. Transactions that are not notified: The building permit is not notified to the neighbor. Therefore, the lawsuit period for the neighbor is calculated from the date the transaction was learned. The date of learning must be proven in writing or another document.

3. Implied Rejection and Term of Action

Silence is also a process in administrative justice. According to Article 10 of Law No. 2577, those concerned may apply to the administration to take action that may be subject to administrative litigation. If the administration does not respond within thirty days, the request is deemed rejected. The relevant person may file a lawsuit with the administrative court within the filing period starting from the expiration of thirty days. If the administration gives a non-conclusive answer within thirty days, the relevant party may either consider this answer as rejection and file a lawsuit or wait for the definitive answer. The waiting period cannot exceed four months from the application date. In cases where a lawsuit is not filed or the case is rejected out of time, if a response is given after the thirty-day period, a lawsuit may be filed within sixty days from the notification of the response.

Duration: As a rule, the period for filing a lawsuit is 60 days from the written notification (Article 2577). After an implied rejection, this period starts from the date on which thirty days expire.

Application to a higher authority: The same process can also be requested by applying to a higher authority (for example, the governor's office). Application to the higher authority stops the period of filing a lawsuit that has already started. If no response is given within thirty days, the request is deemed rejected and the time starts again from where it left off (Article 2577, 11).

4. Transactions that can be taken as a subject of litigation

Rejection of the application or implied rejection: Rejection or leaving unanswered of the neighbor's application for demolition, sealing or license cancellation. In the petition, it is stated that the administration did not take action despite the clear order of the law.

Cancellation of the building license: It may be claimed that the relevant license was issued contrary to the zoning plan, regulations or urban planning principles. When requesting the cancellation of the license, the license holder also becomes a party in the case.

Suspension of execution: If construction is ongoing, a suspension of execution of the process should be requested before the construction is completed. In buildings that have been completed and transferred to condominium ownership, the effect of the cancellation decision may be limited and should be evaluated separately.

5. Neighbor's Competency to Sue

An annulment case is filed by those whose interests have been violated by an administrative action, in accordance with Article 2 of Law No. 2577. In the decisions of the 6th Chamber of the Council of State, this interest is defined as a "personal, legitimate and current" interest. A serious and reasonable relationship is required between the transaction in question and the plaintiff, and the capacity to file a lawsuit is evaluated by the court according to the nature of each dispute (for example, Council of State 6th Chamber, 06.10.2021, E.2020/5687, K.2021/10811). The decisions of the same Department on zoning and building license files show that the license can change from file to file and that proving the connection with the real estate is decisive. For this reason, documents showing ownership ties for adjacent or close parcel owners must be added to the petition from the beginning.

Powerful position: The owner or user of a parcel adjacent to or on the same island. In cases where the building directly affects the drawing distance, light, view and ventilation, a relationship of interest can be clearly established.

More controversial position: The person who lives far away or relies solely on the title of fellow countryman. The Council of State's approach to this issue varies depending on the file. The personal interest connection must be clearly explained in the petition.

Concrete Application Scenario

The following scenario is fictional; It has been prepared to explain a typical situation in practice.

Event Summary

In a fictional example, a parcel owner learned that a fourth floor and a balcony extending into the drawing distance had been added to a three-storey building licensed on the adjacent parcel. He made a written application to the municipality and did not receive a response even though thirty days had passed.

Legal Evaluation

First, the date of the application must be documented. At the end of thirty days, the application is considered rejected and a lawsuit can be filed against the implied rejection in the administrative court within 60 days. In the petition, it is stated that Article 32 of Law No. 3194 imposes an obligation on the administration to carry out detection, sealing and demolition procedures, and that the execution should be stopped since the construction is continuing. Photographs, measurements and title deed records, if any, are added to the petition.

Frequently Asked Questions

What should I do if the municipality does not respond?

At the end of thirty days, the application is considered rejected. As of this date, a lawsuit can be filed with the administrative court within the filing period (Article 2577, 10).

How long is the lawsuit duration?

As a rule, it is 60 days. If the administration gives a non-final answer within thirty days, a definitive answer may be expected, but the waiting period cannot exceed four months from the application.

If my neighbor's building is completed and the title deed is transferred to condominium, can I file a lawsuit?

A lawsuit can be filed, but the court's assessment of interests and actual situation may be different in finished structures. For this reason, it is important to make the application while the construction is ongoing and to request a stay of execution.

If the municipality does not demolish the building, who will?

The law stipulates that if the administration does not take a demolition decision within two months after the determination or does not implement the demolition decision within six months, the demolition can be carried out by the Ministry. The cost is collected from the administration (3194 art. 32/5).

Attention: Common Mistakes in the Process

Be content with a verbal complaint: A telephone or face-to-face complaint does not initiate the implied rejection period. A written and dated application is required.

Calculating the time incorrectly: The thirty-day response period and the 60-day lawsuit period are different from each other. After the implied rejection, the litigation period begins.

Not knowing the construction registration document or zoning amnesty defense: The administration may claim that the building is within the scope of a zoning amnesty or registration document. This possibility should be asked from the administration before opening the file.

Conclusion

The neighbor's illegal structure concerns both individual property rights and planned and safe construction order. The law imposes detection, seal and demolition obligations on the municipality. When the administration does not fulfill this obligation, the neighbour's written application results in implied rejection and opens the way to appeal to the administrative court. Küheylan Law Firm carries out the litigation process by planning the license and project review in such files, making the application dated and in accordance with the procedure, tracking the implied rejection period, and requesting a stay of execution when necessary.
