Foreigner Who Had a Traffic Accident in Türkiye: Ban on Traveling Abroad, Compulsory Insurance and Compensation Process Highway Traffic Law No. 2918, art. 85, art. 91; Criminal Procedure Law No. 5271, art.100, art.109; Turkish Penal Code No. 5237 Art.85, Art.89 was prepared based on the legislation in force as of 2026 and official sources dated October 2026.
In Türkiye, a foreigner involved in a traffic accident is involved in both criminal investigation and compensation processes, depending on the nature of the accident. In accidents that result in injury or death, an investigation is conducted against the suspect. The return of the foreigner to his country may be evaluated in terms of suspicion of escape, and the judge may impose a ban on leaving the country within the scope of judicial control (CMK article 109/3-a). If there is no compulsory liability insurance valid in Türkiye for vehicles with foreign license plates, this insurance is taken out at the border entry (KTK article 91). It is important that the right to a translator and lawyer and compensation claims are followed in a timely manner during the process.
What is the Legal Status of the Foreigner After the Accident?
In a traffic accident involving injury or death, the suspect testifies during the investigation. In criminal law, the crimes of reckless homicide (TCK Article 85) and reckless injury (TCK Article 89) may come to the fore. The process proceeds differently depending on the nature of the accident and the fault. A foreign suspect enjoys the same guarantees as a Turkish citizen: the right to counsel, the right to remain silent, and the right to an interpreter if he does not speak Turkish. Details of these rights are discussed in the detained foreigner's rights guide.
The fault rate, crime scene and vehicle information in the accident report form the basis of the criminal file and compensation cases. For this reason, it is important that the report is not signed without understanding it and that it is prepared with a translator when necessary.
Why Is There a Ban on Traveling Abroad?
In cases where there are reasons for arrest pursuant to CMK Article 109, a judicial control order may be issued instead of arrest. Not being able to go abroad is also included among the judicial control obligations (Art. 109/3-a). The reasons for arrest are regulated in CMK Article 100, and the most important of these are concrete facts that raise suspicion that the suspect will escape. The fact that the foreign national suspect is not resident in Türkiye may be a factor that the judge may take into consideration in practice in terms of suspicion of escape. This does not mean that being a foreigner alone is grounds for arrest or exit ban. The judge decides based on concrete facts.
A request can be made to the judgeship to lift or ease the ban on going abroad. Objections to decisions can be made within seven days from the date of notification or learning. For the foreign suspect, options such as employment, family and residence information, showing the address where he will stay in Türkiye, security and regular application obligations are important for the judge's evaluation. Whether these options are accepted or not depends on the file.
How Does Compulsory Insurance Work on Vehicles with Foreign License Plates?
Highway Traffic Law No. 2918, Article 91, requires operators to have liability insurance. The sixth paragraph of the law regulates that if vehicles with foreign license plates do not have valid insurance in Türkiye, compulsory liability insurance must be provided for them when they enter the borders of Türkiye. Vehicles that do not have compulsory insurance based on valid coverage amounts will be banned from traffic. The liability of the operator is regulated in Article 85.
Third parties injured in the accident can submit their compensation claims to the insurer. International insurance documents and border insurance applications should also be examined. The scope of the insurance policy, the amount of coverage and the validity period of the policy are decisive in claims.
Can a Foreign Accident Victim Request Compensation?
A foreigner who is injured or loses a relative in a traffic accident in Türkiye can submit compensation claims to the operator, driver and compulsory insurer. Items such as treatment expenses, temporary and permanent incapacity, loss of support and moral compensation come to the fore depending on the file. Application and lawsuit conditions to the insurer, statute of limitations and the impact of the criminal case should also be examined. If the foreign victim is abroad, documents such as power of attorney, apostille and translation come into question.
Is Residence Status Affected After the Accident?
Criminal investigation may be a separate evaluation subject within the scope of residence permit. In cases deemed to be a threat to public order or security, administrative procedures may be brought to the agenda within the scope of Law No. 6458. As a rule, traffic accidents that are simple and caused by negligence may not lead to this result. However, the criminal file and the residence permit must be followed together.
Vehicle with foreign plate If there is no valid insurance, compulsory liability insurance is provided at the border (Art. 91)
Incident Summary Form: Fictional example: A foreign driver who comes to Türkiye for vacation is involved in an accident with injuries. His statement is taken without a translator and the judge imposes a travel ban on him with a judicial control order. The person wants to shorten his holiday and return to his country. Process: The lawyer examines whether the statement was taken in accordance with the procedure and evaluates the defect report. By documenting the foreigner's address in Türkiye, family and business information, he applies to the judgeship to lift or ease the exit ban. Result: If the decision is negative, an objection is filed within seven days. The compensation process is carried out separately according to the insurance policy and the fault rate.
Can a foreigner who had an accident in Türkiye return to his country immediately?
In cases of accidents involving injury or death, the judge may impose a travel ban within the scope of judicial control. The decision varies depending on the file. What can be done against the ban on traveling abroad? It may be requested to remove or reduce the judgeship. An objection can be made against the decision within seven days from notification or learning.

Can the residence permit be canceled after an accident?

Signing the accident report without understanding and without an interpreter.
Missing the objection period against the travel ban.
Failure to check the scope and validity of vehicle insurance.
Trying to leave the country while there is a ban on leaving the country.
