Marrying a Foreign Person in Türkiye: Marriage License Certificate, Health Report and Translator MÖHUK no. 5718 art.5, art.13; Turkish Civil Code No. 4721, article 124; Regulation on the Implementation of the Population Services Law; Article 37 of Law No. 6458 was prepared based on the legislation in force as of 2026 and official sources dated October 2026.
Couples who want to marry a foreign national in Türkiye must present a marriage license certificate, health report and valid identification document for the foreign party when applying to the marriage officer. The capacity and conditions for marriage are subject to the national law of each party, and the form of the marriage is subject to the law of the country where it was made (MÖHUK article 13). Since the document list may vary depending on the civil registry office, the current list must be confirmed before application. Since marriage is a legal transaction that initiates the residence permit and citizenship processes, correct preparation of records also affects subsequent applications.
What Law Applies to Marrying a Foreigner in Türkiye?
MÖHUK article 13 brings three separate rules. The capacity and conditions for marriage are subject to the national law of each party at the time of marriage. The law of the country where the marriage took place is applied to the form of the marriage, that is, if the marriage is to be held in Türkiye, Turkish law applies. The general provisions of marriage are subject to the common national law of the spouses, to the common habitual residence law if they have separate citizenships, or to Turkish law if that is not the case.
For this reason, a foreigner's age, whether he has been married before or other circumstances that prevent marriage are examined according to the law of his own country. However, if the application of foreign law results in clearly contrary to Turkish public order, it may not be applied in accordance with Article 5 of MÖHUK. For example, according to the Turkish Civil Code, as a rule, a person who is under the age of seventeen cannot marry (Art. 124). The fact that foreign law allows a lower age is also evaluated in terms of public order.
What Documents Are Required for the Foreign Party?
Marriage procedures are carried out in civil registry offices. According to the information and practice of the General Directorate of Population and Citizenship Affairs, the following documents are generally brought to the agenda:
Marriage license certificate: A document issued by the competent authorities of his/her own country or the embassy or consulate in Türkiye, showing the foreigner's identity information and that there is no obstacle to marriage. If the validity period is not specified in the document, it is considered valid for six months from the date of issue. The document is presented with the necessary approval or apostille annotation in practice.
Health report: A pictorial report showing that there is no health condition that prevents marriage. The report is received from the relevant health institution.
Identity document: Valid passport or ID document.
Photo: Current, usually four passport size photographs.
Translator: A sworn or authorized translator who will be present during the marriage process for the party who does not speak Turkish.
If one of the parties is under eighteen years of age, additional documents such as permission of the legal representative are requested. For people under the age of seventeen, the Turkish Civil Code allows marriage with the permission of a judge only in extraordinary circumstances (Art. 124). If the documents are in a foreign language, Turkish translation and notary approval may be requested. The list above is an example. The current demands of the civil registry office where the application will be made should be learned.
How does the marriage application and marriage process proceed?
The couple applies to the authorized marriage officer with the documents. The officer examines the documents and IDs, records the application and announces the ceremony date. The validity period of the marriage approval is six months in practice. Marriage can only take place in front of an official marriage officer in Türkiye. A religious ceremony alone does not produce legal consequences.
If the foreign party does not know Turkish, the translator fee is covered by the couple. The interpreter ensures that the statements are understood by both parties during the ceremony. Therefore, the interpreter must be arranged in advance and identification documents must be presented.
How Do Residence and Citizenship Processes Begin After Marriage?
With marriage, the foreign spouse's right to stay, residence permit or citizenship processes come to the fore. The foreign spouse can apply for a family residence permit on the basis of marriage. This permission depends on the sponsor's conditions and whether the marriage is real. Article 37 of Law No. 6458 regulates that if there is reasonable suspicion that the marriage was made solely for the purpose of obtaining a residence permit, governorships may conduct investigations and, in case of detection, the residence permit will not be granted or canceled. Details regarding citizenship through marriage and family residence are explained in separate guides.
If both spouses are foreigners, the right to stay is evaluated separately according to their residence permit types.
